Terms of Use

These terms govern access to and use of the Ma Maison à Moi platform. By creating an account, posting a listing, or simply browsing the site, you accept these terms in their entirety.

1. Purpose and acceptance

These general terms of use (the "Terms") set out the rules for accessing and using the Ma Maison à Moi platform, available at mamaisonamoi.com and through its associated interfaces (hereinafter "the platform"). They apply to any person who browses the site, creates an account, posts a listing, or requests one of our services.

The platform is published by OUENZE SARLU (symbol OZ), a single-member private limited liability company (SARL unipersonnelle) incorporated under Congolese law, with its registered office at n° 2, avenue Okito, Quartier Révolution, Commune de la Gombe, Kinshasa, Democratic Republic of the Congo. The platform's application layer is hosted by Vercel Inc. (United States) and its database by Neon (managed PostgreSQL). The processing of personal data is detailed in our privacy policy, which supplements these Terms.

In these Terms, "advertiser" means any person who posts a property on the platform (owner, agent, or agency); "visitor" means any person searching for a property to rent or buy; "listing" means the record describing a property; "verified badge" means the mark attesting that a physical visit and checks have been carried out under the conditions described in Article 5.

Use of the platform constitutes full and complete acceptance of these Terms. Any person who does not accept these Terms must refrain from using the platform. Certain features or services may be governed by specific terms, which apply in addition to these Terms without replacing them.

2. Description of the service

Ma Maison à Moi is a verified real estate marketplace dedicated to Kinshasa (Democratic Republic of the Congo). It connects advertisers with people looking for a home to rent or a property to buy, and offers related services (viewing, valuation, lease and condition report, rental management, monthly rent payment, diaspora offer).

The platform's distinctive feature is verification: every property published with the "verified" badge has undergone a physical visit by our teams. Visit findings are documented with geolocated, time-stamped photographs sealed by a cryptographic signature that guarantees their integrity. The checking of land titles is a separate operation, described in Article 5.

The platform acts as an intermediary. It does not conclude rental or sale contracts on behalf of the parties: the lease, the sale, or any other commitment is formed directly between the advertiser and the visitor. The platform facilitates the introduction, the verification, and, where applicable, support, but is not a party to these contracts.

The platform does not sell commercial contacts or telephone numbers. It displays no advertising and installs no third-party advertising tracking devices. Its business model rests exclusively on the fees and commissions described in Article 6.

3. Account, login, and responsibility of the number holder

Access to personal features requires the creation of an account. The account has no password. The identifier is the user's telephone (WhatsApp) number. Login is carried out by means of a six-digit code sent to that number via WhatsApp, to be entered on the platform.

Open sessions can be revoked at any time from the personal area. The session is maintained by a technical session cookie, strictly functional in nature, transmitted in httpOnly mode. No tracking cookie is placed.

The holder of the telephone number associated with the account is deemed to be the author of the actions carried out from that account. It is their responsibility to retain control of their number and their WhatsApp access, and to report to the platform without delay any loss, theft, or unauthorized use. The platform may suspend access in the event of suspected fraudulent use.

The user undertakes to provide accurate information when creating the account and to keep it up to date. They must have the legal capacity required under Congolese law to enter into commitments. A single user may not open multiple accounts for the purpose of circumventing the platform's rules.

4. Advertisers' obligations

The advertiser guarantees the accuracy of the information they publish: location, surface area, condition, rent or price, charges, and terms. They refrain from any misleading presentation, any photograph that does not correspond to the actual property, and any information likely to mislead a visitor.

The advertiser represents and warrants that they have the right to offer the property for rent or sale: either as the owner or by virtue of a valid and current mandate. They must be able to substantiate this right at the platform's request.

Posting a listing is subject to an identity check (identity barrier). The advertiser undertakes to submit to this check, not to use a false identity or a false mandate, and to provide authentic documents.

The advertiser keeps their listing up to date and removes it as soon as the property is no longer available. They comply with the reciprocal number-masking rules described in Article 7 and do not seek to circumvent them.

5. What verification guarantees and does not guarantee

The "verified" badge attests that a physical visit to the property was carried out by our teams and that checks were performed: on-site observation, consistency of the advertised information, geolocated, time-stamped, and sealed photographs. It reflects due diligence at a given moment, not an opinion on the advisability of a transaction.

The "verified" badge is not proof of ownership. It does not establish, on its own, that the advertiser holds a right of ownership over the property. The checking of the land title is an operation distinct from the physical verification; it is mandatory in the event of a sale and is subject, where applicable, to a separate check.

Verification reports on the condition of the property and the elements observed at the time of the visit. It guarantees neither the subsequent evolution of the property, nor the conduct of the parties, nor the outcome of the rental or sale.

It is for each party to carry out the legal and documentary checks incumbent upon them, in particular the checking of the land title before any sale. The platform may support these steps but does not substitute itself for them.

6. Verification fees and commission

The verification of a property gives rise to verification fees, set in tiers according to the commune (center, ring, outskirts) and, where applicable, accompanied by supplements (title check, lease preparation, diaspora offer). The applicable schedule is published on the platform, on the page dedicated to prices and commissions.

A commission is due only if the property is actually rented or sold through the platform. No commission is charged when the introduction does not result in any transaction.

The platform sells neither commercial contacts, nor telephone numbers, nor advertiser or visitor data. No remuneration is received in respect of any such transfer.

Verification fees and commissions are inclusive of all taxes. An electronic receipt is issued after each payment, from the platform.

7. Reporting and immediate masking

Any person may report a listing they consider fraudulent, misleading, or contrary to these Terms. Under the immediate-masking rule, a reported listing is withdrawn from display while it is being examined, then reinstated or permanently removed depending on the outcome of that examination.

In order to prevent abusive reporting, the platform retains a fingerprint of the IP address behind the report in a salted and non-reversible form, which does not allow the address itself to be traced back.

The platform implements fraud sensors, in particular the detection of abnormal prices, of photographs already seen elsewhere, and of negative visit feedback. After a visit, a "did you visit this property?" verification loop makes it possible to confirm that the visit actually took place.

The advertiser's number and the visitor's number are reciprocally masked until the visit is confirmed. Any attempt to circumvent this masking is prohibited and may lead to the measures provided for in Article 10.

8. Prohibited conduct

The following are prohibited in particular: publishing false or misleading listings; using false or expired mandates; displaying misleading or artificial prices; impersonating a third party.

Also prohibited are circumventing the reciprocal number masking, republishing a permanently removed listing, and any maneuver intended to deceive the fraud sensors or to distort reports.

The user refrains from any unlawful or abusive conduct: harassment, statements or content contrary to the law, infringement of the rights of third parties, or any use of the platform for purposes unrelated to its object.

The automated extraction or collection of the platform's content, as well as any attempt to hinder its operation or to compromise its security, are prohibited.

9. Limitation of the platform's liability

The platform acts as an intermediary. It is not a party to the rental or sale contracts concluded between advertisers and visitors and cannot be held liable for their performance, their non-performance, or the disputes arising from them.

Verification constitutes a best-efforts obligation and not an obligation of result. It reflects due diligence carried out at a given moment and guarantees neither ownership of the property, nor the conduct of the parties, nor the outcome of a transaction. The "verified" badge does not constitute proof of ownership, as recalled in Article 5.

The platform cannot be held liable for damage resulting from an event of force majeure, from the act of a third party, from an interruption or temporary unavailability of the service, or from use that does not comply with these Terms.

Within the limits permitted by applicable law, the platform's total liability is limited to the amount of the fees actually paid by the user over the preceding twelve months. The following are excluded: indirect damage, loss of opportunity, the acts of a user or of a third party, and the information provided by owners, which verification is not intended to guarantee beyond what the charter describes. No provision of these Terms may exclude a liability that cannot lawfully be excluded.

10. Suspension and termination

In the event of a breach of these Terms, in particular in the event of fraud, a false listing, a false mandate, or circumvention of the masking rules, the platform may restrict access, mask or remove a listing, and suspend or close the account concerned, without prejudice to any other legal remedy.

The user may at any time request the closure of their account from their personal area or by writing to bonjour@mamaisonamoi.com.

Closing the account entails the removal of the listings attached to it. Certain data is retained for five years after closure, in order to meet legal obligations, prevent fraud, and establish proof of a right. Our privacy policy sets out these periods.

11. Amendment of the terms

The platform may amend these Terms in order to reflect changes in the service, in regulations, or in its practices. Users are informed of significant changes by an appropriate means.

Continued use of the platform after a new version takes effect constitutes acceptance of it. The effective date and the date of last update of these Terms are as follows: 21 August 2026.

12. Governing law and dispute resolution

These Terms are governed by the law of the Democratic Republic of the Congo.

In the event of a dispute, the parties shall first endeavor to seek an amicable solution. Any complaint may be sent to bonjour@mamaisonamoi.com.

The parties have thirty days from the complaint to reach an amicable settlement. Failing agreement within that period, the dispute is brought before the courts of Kinshasa/Gombe.
